Privacy Policy

This Privacy Policy is binding solely in its English-language version. Translations into any other language are provided for convenience only; in the event of any inconsistency, the English version governs.

1. Introduction and Scope

This Privacy Policy (the “Policy”) describes how OpenHype Limited (“OpenHype,” the “Company,” “we,” “us,” or “our”), incorporated in the British Virgin Islands, collects, uses, discloses, retains, and safeguards your personal information when you access or use the OpenHype website (openhype.com), applications, platform, and related services (collectively, the “Service”).

This Policy forms part of, and should be read together with, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. This Policy does not apply to personal information we process about our personnel or job applicants.

Please review this Policy carefully. If you do not agree with our practices, do not access or use the Service. If you have questions, contact us at support@openhype.com.

The Service is not offered to residents of certain restricted jurisdictions (including the United States, mainland China, Hong Kong, Canada, the United Kingdom, Japan, and Russia) as set out in the Terms of Service.

2. Personal Information We Collect

The categories of personal information we collect depend on how you interact with the Service.

A. Information You Provide Directly

  • Account and identification data, such as your username or display name, email address, and any other details you enter during registration.
  • Verification data (KYC/AML), such as government-issued identification documents, photographs, date of birth, and associated identity or verification data, where identity verification is required for legal, tax, anti-money laundering, counter-terrorism financing, or fraud-prevention purposes.
  • Shipping and redemption data, such as your full name, postal address, email address, and phone number, which are required when you request redemption and shipping of a physical Card.
  • Payment data, such as the stablecoin (USDC/USDT) wallet address from which you pay, transaction amounts and confirmations, and limited card-payment metadata. Full credit or debit card numbers are processed and stored exclusively by our PCI-compliant third-party payment processor and are not stored by OpenHype.
  • Communications, such as the content of support requests, messages, feedback, and any correspondence you send to us or post on our official social media accounts.
  • Marketing preferences, such as your choices about receiving promotional communications.
  • Other information you actively choose to submit.

B. Information We Collect Automatically

When you access or use the Service, we and our service providers may automatically collect:

  • Device information, such as device type and model, operating system, browser type and version, language settings, screen resolution, unique device identifiers, IP address, and general location (city/region).
  • Usage information, such as pages and screens viewed, features used, pack openings and outcomes, buyback and redemption activity, clickstream and navigation paths, referring/exit URLs, time spent, and timestamps.
  • Log data, such as access times and error logs.
  • Information collected via cookies and similar technologies, as described in Section 5.

C. Information from Other Sources

  • Payment-related blockchain data. Where you pay using a stablecoin, the wallet address you transact from and the corresponding on-chain transaction are recorded on a public blockchain and are inherently public. OpenHype does not operate, custody, or provide any cryptocurrency wallet, custody, exchange, or blockchain service, and does not hold any crypto asset on your behalf. We observe such public transaction data only to confirm and reconcile payments.
  • Payment processors and providers, which share transaction confirmation data, payment status, and fraud-prevention signals (without sharing full card numbers).
  • Identity verification provider, which shares the results of any required verification.
  • Social media platforms, such as your public handle and content if you engage with our accounts.
  • Analytics, marketing, and data providers, which provide aggregated or pseudonymized data about usage and audiences.

3. How We Use Personal Information

We use personal information to:

  • Provide and operate the Service, including enabling registration, processing Credit purchases, executing pack openings, displaying outcomes, administering buyback offers, and arranging redemption and shipping of physical Cards.
  • Process payments, including verifying and reconciling stablecoin and card payments and managing related fees.
  • Verify identity, where required for compliance, fraud prevention, or security.
  • Communicate with you, including sending transactional notices (such as purchase confirmations and shipping updates), responding to inquiries, and providing support.
  • Improve and personalize the Service, analyze usage, fix errors, and develop new features.
  • Conduct research and development, including creating aggregated or de-identified statistics.
  • Send marketing communications, where you have opted in or as otherwise permitted by law (you may unsubscribe at any time).
  • Ensure security, prevent fraud, and protect rights, including detecting and addressing fraud, abuse, prohibited conduct, and circumvention of geographic or eligibility restrictions, and enforcing our Terms of Service.
  • Comply with legal obligations, including tax, record-keeping, anti-money laundering, sanctions, and other legal or regulatory requirements, and responding to lawful requests.

Legal bases (where the GDPR or similar laws apply). Where applicable data protection law requires a legal basis, we rely on: (i) performance of a contract with you; (ii) our legitimate interests (such as security, fraud prevention, and improving the Service); (iii) your consent (such as for certain marketing or cookies), which you may withdraw at any time; and (iv) compliance with a legal obligation.

4. How We Disclose Personal Information

We do not sell your personal information. We may disclose it to the following categories of recipients:

  • Service providers, such as hosting, payment processing, identity verification, analytics, customer support, email delivery, logistics/shipping, security, and fraud-prevention vendors, who are contractually obligated to protect your information and use it only on our behalf.
  • Vault, grading, and fulfillment partners, to the extent necessary to authenticate, store, and ship physical Cards.
  • Professional advisors, such as lawyers, auditors, insurers, and accountants, in the course of their services.
  • Authorities and other parties, where we believe in good faith that disclosure is necessary to comply with applicable law, legal process, or governmental request, or to protect the rights, property, or safety of OpenHype, our users, or the public.
  • Business transferees, in connection with an actual or proposed merger, acquisition, reorganization, sale of assets, or insolvency, and during related due diligence.
  • With your direction or consent, for any other disclosure you authorize.
  • Aggregated or de-identified data, which we may share for any lawful purpose.

Public blockchain. Stablecoin payment transactions are recorded on a public blockchain and cannot be altered or deleted by us. Any wallet address you transact from, and the associated transaction record, may be publicly accessible.

5. Cookies and Tracking Technologies

We and our service providers use cookies, local storage, web beacons/pixels, and similar technologies to operate the Service, remember your preferences, maintain security, analyze usage and performance, and measure marketing. We may use third-party analytics and advertising tools for these purposes.

  • Essential technologies are necessary for the Service to function (such as authentication, session management, security, and payment processing).
  • Analytics technologies help us understand how the Service is used and improve it.
  • Marketing technologies help us measure and improve our campaigns.

You can manage cookies through your browser settings (blocking or deleting cookies may affect functionality) and through available privacy plug-ins. Do Not Track: our systems do not currently respond to browser “Do Not Track” signals. Because these controls are browser- and device-specific, you must set them on each browser and device you use.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with our legal, tax, accounting, anti-money laundering, and record-keeping obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type and purpose. When personal information is no longer needed and no legal obligation requires its retention, we will securely delete or anonymize it within a reasonable timeframe. Blockchain transaction data is permanent and immutable and cannot be deleted, modified, or removed by OpenHype.

7. Your Privacy Rights

Depending on your jurisdiction and applicable law, you may have the right to:

  • Access a copy of the personal information we hold about you;
  • Correct inaccurate or incomplete information;
  • Delete information we no longer need (subject to legal exceptions and to the immutable nature of blockchain data);
  • Object to or restrict certain processing;
  • Data portability in a structured, commonly used, machine-readable format;
  • Withdraw consent where processing is based on consent, without affecting prior processing; and
  • Lodge a complaint with a competent supervisory authority in your jurisdiction.

To exercise any of these rights, email us at support@openhype.com. We may verify your identity before responding and will respond within the timeframes required by applicable law. You may use an authorized agent, in which case we may require additional verification. Please note that wallet addresses and transaction data recorded on a public blockchain are publicly accessible and immutable; deletion and correction requests apply only to off-chain data within our control.

8. International Data Transfers

OpenHype is incorporated in the British Virgin Islands, and we and our service providers may operate in, and process personal information in, various jurisdictions, which may have data protection laws that differ from those of your country of residence. Where we transfer personal data from the European Economic Area or other jurisdictions that require it, we implement appropriate safeguards (such as Standard Contractual Clauses approved by the European Commission and data processing agreements imposing appropriate protections), or rely on another lawful transfer mechanism.

9. Security

We implement commercially reasonable technical, organizational, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction, including encryption of data in transit, access controls on a need-to-know basis, and reliance on PCI-compliant payment processors that store card data (we do not store full card numbers). However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and any payment wallet you control.

10. Data Breach Notification

In the event of a personal data breach likely to result in a risk to your rights, we will notify the relevant supervisory authority and affected individuals where, and within the timeframes, required by applicable law, and will take appropriate steps to investigate, document, and remediate the breach.

11. Children’s Privacy

The Service is not directed to, and we do not knowingly collect personal information from, anyone under eighteen (18) years of age. If we learn that we have collected personal information from a person under 18, we will take steps to delete it. If you believe a minor has provided us personal information, please contact us at support@openhype.com.

12. Third-Party Links and Services

The Service may link to or integrate third-party websites, applications, and services (including payment processors and social media platforms). We do not control and are not responsible for the privacy practices of those third parties. Your use of them is governed by their own privacy policies, which we encourage you to review.

13. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will post the revised Policy, update the “Last Updated” date, and, where practicable or required by law, provide notice through the Service or by email (and obtain your consent where required). Your continued use of the Service after the effective date of any revised Policy constitutes acceptance of the changes.
